  4. I was onto this fear-thing last week here in comments, but I was against how the dems ganged-up on Obama by not supporting a rapid closing of Guantanamo Bay Detention Center.
    These damn repuggs are the same bunch that tried to scare us into duct-taping our windows and all that nonsense, as well they are the same ones who tried to make us feel unpatriotic if we ordered FRENCH fries, although I suppose we should have only been suspicious of the people who dipped their fries, freedom or French, into mayonaise instead of ketchup.

    Craig's right---we ALREADY HAVE scary people locked up here in the USA, as we all know.
    What's a couple hundred "usual suspects, Rick" going to do to upset this country where the prison population is already so high, ranking us way up there in prison bragging rights..".we're #1 !! we're # 1"
    The king of the world in prison expertise and torture, the USA, should be able to handle a couple hundred more bad guys, or maybe-bad-guys-maybe-juvenile-taxicab-drivers.

What could get more scary than thinking you married a handsome, sweet, wonderful man and several years later you end up at the bottom of San Francisco Bay with cement assessories.   36. what are the numbers ($$$) on closing gitmo prison, dumping or transferring and maintaining the 200 odd detainees vs. just maintaining them and the prison infrastructure and holding requisite trials there? a lot of costs to look at.... food, utilities, guards, lawyers, judges, public relations, et al.

    A-P that "Keeping America safe is Job one" v. "Protect and Preserve the Constitution" argument is a canard that repugs have dummied up so that they can be on both sides of the argumetn when it's convenient. It's what they rolled out after 9/11 to justify under the (a) side passing the Patriot Act, suspending any semblence of justice for our prisoners, and to decimate any rights prisoners captured by bounty hunters in the ME would otherwise have under the GCs, the guidelines for treatment of prisoners and detainees under the Army Handbook, or, god forbid, the Constitution. Of course when Obama says his "first job" is keeping America safe, the repugs say, "Oh, no. You have sworn to preserve and protect the Constitution" as if the two responsibilities are mutually exclusive. In fairness, both sides use this dichotomy dishonestly. Keeping
    America safe is certainly a responsibility of the president, as is preserving and protecting the constitution - and considering the past 7 years, I rather like to think that Obama has a better understanding of that than the Cheney/Bush cabal.

  51. Jamie, if those 3 reversals are what they hit hard on, she'll have an easy confirmation fight. She was writing the decisions in those cases for the majority of the second circuit - not a hotbed of judicial activism in any event - on 3 fairly arcane and technical aspects of securities law, tax law and copyright law.

    Knight affirmed a tax court ruling that made SCOTUS because of a deep division among the Circuit courts - hardly a basis for much of a challenge worthy of dicussion of a SCOTUS nominee.

    Dabit applied a narrow reading of SLUSA claims that SCOTUS said should be applied broadly, for among other things, policy considerations. Not much for repugs to get excited about there.

    And Tasini was again broadening the application of copyright protection for individual works in a larger collective database beyond what the 2nd circuit had applied. Again, not exactly a sexy subject.

    I doubt that many, if any, of the senators who will be questioning her will understand, much less be able to argue her opinions as being cases of judicial activism.

  77. Viva Sotomayor! It's nice to finally pick a "winning horse". I pegged Sotomayor as soon as the initial pool was announced---it was really a no-brainer---and she SHOULD sail through confirmation hearings. I say 'should' cuz we all know the idiots are itching for a fight.
    Obama had a personal sit-down with Sotomayor for seven hours in the White House to vet her...I hope he didn't miss anything. Good luck to Federal Appeals Court Judge Sonia Sotomayor in her quest to climb the steps at the high court.

    Man dies after rescuing 7-year-old boy from pit

    A 58-year-old man has died after rescuing a 7-year-old boy who fell into a water-filled hole at a Detroit construction site.

    Wayne State University police Sgt. Robert Barron said the boy was playing Sunday at a home under construction on Miracle Street when he fell into the foundation pit that was dug for the basement.

    The Detroit Free Press and The Detroit News reported the man was Garrett Townsend of Detroit. WDIV-TV says he managed to rescue the child, but wasn't able to get himself out of the water.

    Emergency responders pulled him out and rushed him to a hospital, where he died.

    Gitmo's not closing. They may close the detention facility there, which is a small portion of the base. The cost to continue operating is considerably less than most proposals which involve building a new facility somewhere in the U.S. Regardless, Gitmo the military base, will continue to operate as before.

    Two comments, one narrow, one broader: (1) In context Judge Sotomayor wasn’t making any broad statements about jurisprudence. She was responding to questions about the difference between being a law clerk to a trial judge and a court of appeals judge. Her answer was that trial judges decide individual cases, while court of appeals judges make decisions with a broader scope (“make policy” in the sense that their decisions apply to more than one litigant). A trial judge will use the federal Sentencing Guidelines to assist her in determining the sentence to impose on a specific offender; a court of appeals judge will interpret the Guidelines to determine whether failing to report to prison after conviction (“escape from custody”) is a “violent felony,” for example. (The Supreme Court unanimously said it wasn’t.) Saying that the latter is a policy decision is simply to say that it affects a whole lot of offenders.


    (2) But, more broadly, there’s no particular reason other than conservative ideology to distinguish sharply between “interpreting the law at the Supreme Court” and “policy.” Cases don’t get to the Supreme Court when everyone who examines the relevant legal materials would reach the same answer. They get to the Court when an honest examination of the Constitution’s text, the Court’s precedents, and the like leaves judges divided. (I suppose conservatives think that any such disagreement has to result from a failure to examine the materials honestly, but that’s just a sleazy way of saying that the only honest legal analysts are conservatives.) Figuring out what to do then requires judges to exercise, well, judgment.

    And judgment – the honest, practical judgment of well-trained lawyers – will sometimes require you to consider the consequences of a decision one way or the other. That’s what people who say that judges make policy usually mean – judges do and ought to worry about the consequences of their decisions. Now, of course you can disagree with the “jurisprudence” I’ve sketched, and conservatives do. But it’s just wrong to suggest that when a judge says that judging sometimes involves “making policy,” he means that it involves acting in just the way a legislator would in deciding how to vote – or that it involves “making things up.”"

    I wasn't talking about you in particular other than the "build a new facilty" piece. There is no particular reason that the majority of the 200 or so should stay in military custody.

    There are a minimal number who because of the means used to obtain information from them may make them impossible to try (the really big problem with torturing prisoners), but because of their original acts might be impossible to let go. We managed to hold both Germans and Japanese on American soil until the cessation of hostilities and we could probably do the same with these most difficult cases.

    The following is a facetious statement: We could always return them to the field in Iraq and shoot them legally.

    jax, when I refer to Gitmo I am referring only to the detention center - I'm just lazy that way. And I don't know what plans you've seen that haven't made, like, the media, but what I've seen has not discussed building a new facility. I have looked back through what the Google brings up, and I don't see a single reference on the first two pages that even mentions building another facility. It was a lack of specificity as to where and how the detainnes would be transferred that torpedoed the request - and $80 million is not enough to build a super duper facility wnad move the detainees to it in a year or so. But then I don't get out much.

  110. jamie, re; the CA SupCt. decision - yes, in a sense a new class of folks was created - but they are afforded the rights they sought - as to folks who wanted to get married but didn't have the moxie or whatever to do so before today, they are no different from those who got married before Prop 8 passed, and the CASupCt didn't create them - they merely upheld the creation of the voters in CA. That creation of a new class that receives special treatment is not really unique - in fact it happens all the time. Marriage is particularly prone to create such classes - here's a f'rinstance. WV does not recognize common law marriage - you cannot become legally attached to another person by living with them in WV, and WV does not recognize people who claim to be married via common law in other states UNLESS they have done something to have their CL marriage recognized by the other state. I suspect that people in WV could move to, say PA, which does (I think) allow and recognize CL marriages, have their CL marriage based upon cohabitation recognized in PA, then move back to WV and have it recognized there. Is that stupid enough for you? I think it's fricking nutz.

  126. jamie, since most states' laws were drawn up before marriage was even contemplated for same sex partners and would refer to marriage generally, in all likelihood, absent a state law specifically to the contrary, most states would recognize a marriage from another state IF their laws were applied as written (shich, like sometimes even happens). It does get very complicated because of FF&C and comity. I suspect, though, that most states are drawing up legislation precluding the recognition of marriages that could not have been entered into in that particular state. In By God WV the legislation will have something like "marriages that are contrary to the public policy of the state."

  128. pat, watch out for bogus arguments about the releative costs of housing and maintaining deteainees in Gitmo versus in the states. You will note that there are NEVER any figures attached because the people making those arguments don't have a frickin' clue what they are talking about. Until they provide some evidence about how much it costs to run the Gitmo facility annually, where the detainees will be housed in the US and for how long (you know, like, plans for transfer that have not been rovided yet) and what the marginal costs for housing them in the US in existing or new facilities are, they are, as the old saying goes, talking out of their asses (in the law we call that speculating - or making a wild ass guess - WAG for short).

    I really would have liked to see that picture with the three different types of birds you saw that day. I went out later that same day, and got closer to a unusually beautiful, large cardinal, than I've ever been. It was up on a nearby branch and didn't budge. Wouldn't you know I didn't have my camera with me. Pat, do you have a cell phone with a camera?

  137. Patd, If you can get one, I think you would 'really' enjoy a digital camera. They are compact, very easy to use, and have gone way down in price. You can store pictures on them, put them on your computer, link them to share with others, or have them printed.... either on a do it yourself machine (at Target, WM or wherever) or have them printed. They come with the cord to attach them to your computer.

    With the understanding that the figures can change, you can use $25,000 as a base amount.

    If the combination of your SS and your other adjusted income is below that amount, it is probably non taxable. From 25000 to 34000 then half of your SS could be taxable. Over 34,000 then $4500 plus 85% of the amount over 34,000 would be taxable.

    All of the above is adjustable depending on deductions.

    Would Sotomayor be the First Hispanic Justice?

    It's possible that the answer to this question is "no." Justice Benjamin Cardozo was a descendant of Spanish or Portuguese Jews who immigrated to America, and took great pride in his Sephardic Jewish identity. For details, see Andrew Kaufman's excellent biography of Cardozo.

    That said, ethnic identity is largely a social construct. So I can understand if Hispanics today take special pride in Sotomayor's appointment because she would be the first justice whose parents were recent arrivals from Latin America. Like many racial or ethnic classifications, "Hispanic" is a somewhat arbitrary label. It includes widely divergent groups such as Brazilians and Mexicans, while sometimes being used in a way that excludes Spanish and Portuguese immigrants and their descendants (including Cardozo). That does not mean, however, that the term is completely incoherent. US Hispanics do have a distinct identity of sorts - even if only because American society has historically defined them as such over the last several decades.

    Jamie, I don't believe she'd ever rate SSDI. She's not disabled to the extent of being unable to work. Anyway, she'd be 70 by the time they make that determination. :-) They resist SSDI.

    Flatus, I think she needs to ask or see a table to see if it's a big diff to wait until she's 66 to collect on hubby's or apply this year where she turns 62, then collect on hers later at 66 or 70.

    In any event I did learn they did away with earnings penalties in 2000. I guess taxes are like death.

    btw, isn't SS suppose to be BK by 2025 or so.

  189. Whew, most of it is over. No Solar, her entire home cooked meal, to die for, didn't work. I, on the other hand, carried the food I was eating with me. A little fear just boosts my appetite.

    Maggie scared me because instead of continuing to hide under the bed, she was trying to follow me around and went thru a hole under these little stairs that connect the high part with the lower part of the camp.

    I didn't know exactly where that would lead. I feared she would be stuck between some walls or something and I would have to tear the camp down to find her. She did finally come out from there. After that little fright, the thunder wasn't so scary anymore.

    I know you're Indian, aren't 90+ % in Mexico? However, the last time I spent any time there, I was around some folks that got offended when I said that. Indians were those that did the chores etc. and they said they were Spaniards or Spanish. :-)

    Yeah I got it they weren't too proud of being descendants of Indians, like we do here in the US. The ones I was around down there in the 70s did not have a problem being called Mexican, but Indian was a different, lower caste thing.

    I'm guessing that attitude has changed some since then.

  210. Hey Rez, I think I was an Indian in one of my previous incarnations. May have been Mayan though since I felt a real familiarity with some of the ancient Mayan civilization sites. When I first visited them I felt at home.

    These coastal natives around here in WA have a big canoe culture. You'd fit right in around here . . better than me. They make and use (dugouts); these huge ocean-going ones and travel throughout the Puget Sound and along the WA -BC coasts. They call themselves pullers(paddling).

    When I was making and selling t-shirts with my nephew, we made special ones for local sales with the different canoe crews name on front and "Shut up and Paddle" on the back for everyone behind you to see. :-)

    I went to a hypnotherapist when I was 15 to learn meditation and self hypnosis. Starting meditation that young I've had some very interesting experiences, especially when I met the Dalai Lama.

    The hypnotist was part of some odd religion that believed in angels and aliens influencing people on earth.

    One of my sessions he did try to find out if I had had previous lives. I've never been comfortable with the standard Christian doctrine that is taught these days, but completely denied any past lives in the session.
    It was interesting, and I learned what I didn't believe in, just not what I did believe.

    I'd like to take 6 months some time and spend the time meditating around Pearce, AZ. Near Cochise Pass and the Chiricahua Mountains. There's something very restful about that place. Get a chance to explore in the brain cells I still have left.

    There always seems to be a lot of static in my thoughts. That's one thing I really liked about attending a presentation with the Dalai Lama. Buddhist monks were placed around the auditorium, and the psychic silence and calmness was wonderful.

    I remember Billy Crystal talking about the way he took to horses on the set of one of his movies. Certain activities seem to flow in people. I don't deny some people have had past lives, I just doubt I have.

  244. I'm having trouble staying out of the gardens and getting work done. I love green. We've been having grey days which give plants a good chance to harden and establish before the heat gets here. Guess I missed Bob's blue corn. And to think George said there was no blue food.

    Static as in I think I could hear things, but there's so much noise. A fingernails on the chalkboard noise. Not that I'm currently hearing voices. I kind of felt free to let my mind float in the auditorium with the monks, unshackled.

    There is no growth without change, and there is no change without time. I think time itself is just an egg giving us opportunity to mature. In the OT God said he/she is the great "I am". No change, time and change not needed. Some eggs turn out good, some end up a bit sulfurous.

    And no, I don't believe in hell. Just a concept invented by the Catholic church to scare the superstitious.
