A Question in Spitzer-gate: Why the Details?

The question I have is not why did he do it? That's obvious. Sometimes sex is just sex. I'd like to know the answer to this one: why did the affidavit in the Spitzer case single out Spitzer in providing details about his intimate interaction with a hooker? The affidavit, written by an FBI agent to justify an arrest warrant for the proprietors of the Emperor's Club V.I.P. escort service, covers the misdeeds of 10 clients--all to show that this outfit was indeed a prostitution ring.

Most of the 10 mini-narratives are cut and dry: Client No. Whatever called and arranged for a woman and that's that. The account covering Client 9--whose been identified in news reports as Spitzer--is more elaborate. Not only does it detail how he plotted with one of the defendants to get a prostitute from New York to Washington, where he would rendezvous with her at the Mayflower Hotel; it also includes portions of a wiretapped conversation between the prostitute and her boss after the prostitute's appointment with Spitzer was done. And that transcript includes statements suggesting that Spitzer preferred out-of-the-ordinary services:

LEWIS asked "Kristen" [Spitzer's prostitute] how she thought the appointment went, and "Kristen" said that she thought it went very well. LEWIS asked "Kristen" how much she collected, and 'Kristen" said $4,300. "Kristen" said that she liked him, and that she did not think he was difficult. "Kristen" stated: 'I don't think he's difficult. I mean it's just kind of like...whatever...I'm here for a purpose. I know what my purpose is. I am not a...moron, you know what I mean. So maybe that's why girls maybe think they're difficult..." "Kristen" continued: "That's what it is, because you're here for a [purpose]. Let's not get it twisted - I know what I do, you know." LEWIS responded: "You look at it very uniquely, because...no one ever says it that way." LEWIS continued that from what she had been told "he" (believed to be a reference to Client-9) "would ask you to do things that, like, you might not think were safe -- you know - I mean that...very basic things...." Kristen" responded: "I have a way of dealing with that...I'd be like listen dude, you really want the sex?...You know what I mean."

Was it necessary to put in the part about unsafe sex? Did the FBI and prosecutors in the case want to hammer Spitzer more than the other clients? According to The New York Times, the investigation into the Emperor's Club was triggered after I.R.S. agents were informed by one or more banks that Spitzer was engaging in suspicious cash transactions. (How hard is it to take cash out of a bank and hand it to a prostitution ring without being noticed? Shouldn't a former prosecutor who once headed an organized crime task force know how to do such things?) Perhaps that's why Spitzer receives special attention in the affidavit--which was first filed secretly but which was destined to become public. Or maybe the prosecutors and investigators wanted to give the New York governor, who has cultivated the image of Mr. Clean and who has prosecuted prostitution rings, an extra-sharp poke in the eye.

I'm certainly not calling for sympathy for the fellow. But there is a question to be raised about selective enforcement when it comes to high-priced prostitution rings. Go to the Yellow Pages for Washington, New York, or any other major city. You can find pages and pages of escort services. An undercover agent in a matter of nanoseconds could call any and gather enough information to mount an investigation. Yet only once in a blue moon do any of these enterprises receive such notice. The D.C. Madam still wonders why she was picked on. In this case, it seems that Spitzer led the feds to hookers--not the other way around. And that--fairly or not--makes him the star of the show.

I do not condone anyone who cheats on there spouse. If you actually knew what you were talking about then a better comparison would have been Vitter who I said should have resigned.   3. Spitzer's Scandal: Some Things Don't Pass the Smell Test


    ABC is reporting that Eliot Spitzer came under the attention of the Feds because his bank reported "suspicious money transfers" to the IRS. The Justice Department brought it to the FBI's Public Corruption Squad, who looked into it and found that payments were made to a company called QET, which did business as The Emperor's Club.

    All kinds of questions arise here:

    1. Why would the bank tell the IRS and not Spitzer himself if there was a suspicious transfer? Spitzer is a longtime client, a rich guy and the governor. We're talking thousands of dollars here, not millions. It doesn't make a whole lot of sense that they spotted a "suspicious transfer" made by the governor, and that this is how things began. It's possible it was just ordinary paperwork the bank had to file with the government whenever some particular flag was raised, but if that's the case, why did the DoJ go to DefCon 3?

    2. What is a USA doing prosecuting a prostitution case? This isn't normally what the feds spend their time with.

    3. Mike Garcia is a Chertoff crony. Sources familiar with the investigation say that he sent a prosecution memo to DC two months ago asking for authority to indict a public figure (Spitzer). Which means they had their case made long before the wire tap of February 13. Why did they then include this line from that conversation in the complaint?


    LEWIS continued that from what she had been told "he" (believed to be a reference to Client-9) "would ask you to do things that, like, you might not think were safe -- you know -- I mean that...very basic things...."Kristen" responded: "I have a way of dealing with that...I'd be like listen dude, you really want the sex?...You know what I mean."

    This salacious detail does not seem like it's necessary to make their case, and appears to be added for no other purpose than to destroy Spitzer's career.

    4. How did Spitzer's name get leaked to the media, and who did it? Didn't happen to Dave Vitter.

    5. Why did Mike Bloomberg suddenly start talking about running for governor recently? And why did he give $500,000 to Joe Bruno? He's good buddies with Mike Mukasey. What did he know and how did he know it?

    6. The Mann Act? Are you kidding?

    7. Spitzer's been in the line of fire of the GOP hit squad for a while. Roger Stone, Roger Stone, Roger Stone.

    There are all kinds of things about this that just don't pass the smell test.

    I think it portends two things in America - the death of shame and an overwhelming sense of importance and entitlement. They somehow think that they are of such great import to this Republic that they are simply irreplaceable.

  5. I've had a couple friends that were whore hoppers.

    It is not that complicated nor is it ego based. (as far as I can tell) .

    It seems more like addictive behavior. They cannot stop it anymore than I can just snub out my cigarette habit.

    At least that is what I see.

    Spitzer, like the others tend to be one person to the public and another in private. Sooner or later the two collide and the fallout effects their duplicity for a time but my guess is like any other addiction - the behavior returns.

    Does anybody think Bubba quit chasing tail? (I doubt it)

    I think they all might have had their hearts racing at some point but that was long ago, they eventually become numb to their risky behavior.

    Getting caught is the only way to get the "old" rush so . . . .

    It really is pathological and predictable.

    The pending downfall of Eliot Spitzer is making huge national news, primarily because he's governor of the state where the national news media are located (although there's a recent tape of Katie Couric wondering if the country cares about Bernie Kerik -- who came a lot closer to posing a threat to the nation than Gov. Spitzer). But mention of Kerik, even within parentheses, should remind us that the Spitzer switcheroo -- two fisted crime-fighting prosecutor to alleged Mann Act violator -- is not the most dramatic nor ironic of 180s just among New York prosecutors-turned-pols.


    There is, after all, the case of Rudy Giuliani, the mob-fighting US attorney turned mobbed-up mayor and presidential candidate. Mobbed up?

    Why do you keep lying about this? First of all, the NYT did not say there was any sex involved. It was reported by a anonymous source that there was a perception of an inappropriate relationship between McCain and the lobbist over 10 years ago which both denied. Last most liberal blogs and liberal publications condemned this story as being trash. I guess if you keep repeating the lie enough you will eventually convince someone of your lies.

    As for McCain’s examples, it’s true that there are lobbyists for firemen and senior citizens, but those aren’t the folks running his campaign.

    As you know David, the FBI and prosecutors investigate crimes, not people. This one looks like prosecutors wanted to nail person not crime. And how about Don Siegelman? There is another Democratic Governor who's career was destroyed by a prosecution after a person, not a crime. He sits in jail for seven years.

    I'd like to see Spitzer resign contingent upon the resignation of Vitter and Craig. It's a political prosecution. Keep it political.

    WASHINGTON — An exhaustive review of more than 600,000 Iraqi documents that were captured after the 2003 U.S. invasion has found no evidence that Saddam Hussein's regime had any operational links with Osama bin Laden's al Qaida terrorist network.

    The Pentagon-sponsored study, scheduled for release later this week, did confirm that Saddam's regime provided some support to other terrorist groups, particularly in the Middle East, U.S. officials told McClatchy. However, his security services were directed primarily against Iraqi exiles, Shiite Muslims, Kurds and others he considered enemies of his regime.

    The new study of the Iraqi regime's archives found no documents indicating a "direct operational link" between Hussein's Iraq and al Qaida before the invasion, according to a U.S. official familiar with the report.

    He and others spoke to McClatchy on condition of anonymity because the study isn't due to be shared with Congress and released before Wednesday.

    Spitzer has not even been arraigned for screwing a hooker.

    Anyone who thinks Libby had any choice other than lie about his phone call with Tim Russert or tell the truth and put Cheney in legal jeopardy for ordering him to expose a covert CIA agent is dumber than a signpost.

    The reason Cheney and Libby picked Russert is becuase they thought he might go along with it. He didn't and Libby ended up in jail... well almost. If Bush thought there was no crime, he would have pardoned Libby. Instead, he commuted the sentence.

    It is alleged Sptizer screwed a woman who was not his wife and paid her, same crime as Vitter and similar to Larry Craig except Craig likes men and he doesn't pay.

    If Spitzer is tried and found guilty, no impeachment will be necessary.

    Republicans are opportunists with short memories. When they start calling for Vitter and Craig to step down is when they earn the right to whine about Spitzer. It goes both ways... just like Senator Larry Craig (R-ID).

    Really. The cite is an April 15, 1988 Washington Post story (byline: Howard Kurtz), available only on Nexis.

    Here's the full context:

    Placid of demeanor but pointed in his rhetoric, Jackson struck out repeatedly today against those who suggest his race has been an asset in the campaign. President Reagan suggested Tuesday that people don't ask Jackson tough questions because of his race. And former representative Geraldine A. Ferraro (D-N.Y.) said Wednesday that because of his "radical" views, "if Jesse Jackson were not black, he wouldn't be in the race."

    Asked about this at a campaign stop in Buffalo, Jackson at first seemed ready to pounce fiercely on his critics. But then he stopped, took a breath, and said quietly, "Millions of Americans have a point of view different from" Ferraro's.

    Discussing the same point in Washington, Jackson said, "We campaigned across the South . . . without a single catcall or boo. It was not until we got North to New York that we began to hear this from Koch, President Reagan and then Mrs. Ferraro . . . . Some people are making hysteria while I'm making history."

  39. One clue to the detail regarding Client No.9 is that perhaps they can't prosecute him. The price of services Spitzer paid for is a tip-off that he wanted a dominatrix, the only kind of prostitute that can get away with charging so much. Publicity, not law, is probably the weapon being wielded again him; and Spitzer probably doesn't want to be a high profile test case for why being tied up and abused is not really illegal.
